1.1            This Website www.earthandbaby.co.uk is created, administered and controlled by Consolidated Retailers Ltd, trading as Earth & Baby Co. We are registered in England and Wales under company number 09903776. Unless otherwise specified, the terms “we”, “our”, “us” all refer to Earth & Baby Co.

2.            Eligibility

2.1            To be eligible to register and to purchase goods on this website, and to lawfully enter into and form contracts on this Website under English law, you must be at least 18 years of age and hold a valid credit and/or debit card.

2.2            The Personal Information which you are required to provide when you register as a Customer should be true, accurate, current and complete in all respects;You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

2.3            Any personal data that you provide to us during the registration process will be stored in our database and need not be entered with each new order; it will be automatically entered into the order form. You may alter and change any data at any time and can do so by logging in to the Website and selecting ‘My Account’.

2.4            You are responsible for your Account and for maintaining the confidentiality of your password and user name and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses suffered by you where someone else uses your Account, password or user name, unless this is due to our negligence. You agree to notify us immediately if you become aware or suspect any unauthorised use of your Account, password and username or if You are aware that these have become known to any other party.

2.5            If you forget your password we will reset it upon your request and send it to the email address, which you specified when you registered.

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

4.            Product Descriptions and Images

4.1            We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system.

4.2            Images are for illustration purposes only and may differ from the actual product, whilst every effort has been made to reproduce colours on the Website, there may be some variation due to the limitations within the photographic process and screen variations, therefore exact colour matches are not possible.

4.3            We do not warrant that the product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free. Although we aim to keep the Website as up to date as possible, the information including product descriptions and images appearing on this Website at a particular time may not always reflect the product exactly at the moment you place an order.

4.4            We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website.

5.            Ordering Process and Order Confirmation

5.1            You may select items from a range of products on the Website, details of which will be added to the “Shopping Bag” by clicking on the “Add to Bag” button. We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Payment of the price for the goods represents an offer on your part to purchase the goods. As soon as this offer is acknowledged and accepted by us, via an Acceptance Email (as described below) your order forms a binding contract of sale between you and us.

5.2            To enable us to process your order, you will need to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details.

5.3            You will automatically be sent an email confirming receipt of your order (a “Confirmation Email”) with a summary of the details of your order. The Confirmation Email does not constitute our acceptance of your order; it merely records the fact that we have received your order. Please check that all details in the Confirmation Email are correct. If the details are incorrect or if you do not receive a Confirmation Email please contact us immediately.

5.4            Before placing an order (‘Checking Out’) you can view and amend your order details at any time by clicking on the “Shopping Bag”.

6.            Availability

6.1            All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the item is available from stock or to cancel your order. 

7.            Ordering Errors

7.1            You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

8.            Price

8.1            The prices payable for goods that you order are as set out on our website. All prices are inclusive of VAT (if applicable) at the current rates and are correct at the time of entering information. 

8.2            Where it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, and offer to sell you the goods of the specification and description at the price stated in the email and will state in the email the period for which the offer or the price remains valid.

9.            Payment Terms

We will take payment upon receipt of your order from your credit or debit card. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.

10.            Delivery

10.1            Orders shipped within UK will be dispatched using Royal Mail 2nd class. International orders will be shipped via Royal Mail International Tracked & Signed service where possible, but an alternative may be used depending on the shipping destination.    

10.2            Our delivery charges are set out on the Delivery & Returns section of our website.

10.3            Please note it might not be possible for us to deliver to some locations. If this is the case for your order, we will notify you via the email address you provide.

10.4            We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed and therefore time is not of the essence. In any event, we will aim to deliver your goods within 30 days from the day after the day we received your order. If delivery is delayed beyond this time, we will contact you and either agree a mutually acceptable alternative date, or offer you a full refund.

10.5            You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. 

11.            Cancellation Rights

11.1            Should you wish to cancel your order, you may do so within 14 days of receiving your order.

11.2            If you would like to cancel or amend an order before it has been delivered to you, please contact us as soon as possible after placing the order. We will try our best to deal with your request before the order is dispatched. If this is not possible because the order has already been dispatched, then you will be required to follow our returns process. Items should be returned in their original packaging and you will have to cover the cost of the return.

11.3            You cannot cancel your order if the goods you have ordered are bespoke (i.e. made to order).

11.4            Once we have received the goods back, we will refund any sum debited by us from your credit or debit card within 14 calendar days.

11.5            Only items returned unworn and in their original packaging will be refunded.

12.            Cancellation by us

12.1            We reserve the right not to process your order if:

  • We have insufficient stock to deliver the goods you have ordered;
  • We do not deliver to your area; or
  • One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

12.2            If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.
